The Texas Health and Human Services Commission (HHSC) has officially referred allegations against two Rio Grande Valley healthcare providers to Attorney General Ken Paxton for allegedly promoting birth tourism in the state.
The allegations against Mission Regional Medical Center in Mission and Knapp Medical Center in Weslaco come after a letter penned by Gov. Greg Abbott to the HHSC requesting immediate investigation into advertisements by Mission Regional allegedly promoting “birth packages in South Texas.”

In the letter addressed to Paxton, HHSC says that if the allegations are true the hospitals’ actions are detrimental to the public interest and may be a violation of both state and federal law.
“The HHSC was made aware of the reports describing the advertisements on July 3 and referenced a post on X (formally known as Twitter) of a photo of a billboard with the name of a Texas hospital promoting ‘birth packages in South Texas,’” they also referenced a separate Instagram post from 2023 which suggested “similar conduct has been going on for years.”
During the investigation, they looked at articles online which noted that the website on the billboard, havemybabyinTEXAS.com, which is now defunct, identifies the two hospitals, which are affiliated with the Prime Healthcare Foundation, participating in the alleged scheme.
HHSC added that although the website listed on the billboard has been taken down, the archived version is still available online and was used to identify the hospitals.
In the letter, HHSC chief counsel Karen Ray cited a Texas AG case against a Houston facility “that claims to have facilitated birth tourism for ‘1,000+’ foreign nationals.”
“Among other things, that scheme allegedly involved coaching customers to mislead or deceive federal immigration officials about the purpose of their visits to the United States,” Ray wrote. “I am also aware of related action by the federal government. Just recently, the U.S. Department of Justice directed all United States Attorneys and the Criminal Division to work with the Department of Homeland Security to prioritize the investigation and prosecution of birth tourism schemes.”
The HHSC says that they will continue to update the Texas AG’s office as their “review moves forward.”
