Peñitas Man Sentenced to 35 Years for Murder of Stepdaughter

EDINBURG — In a heartbreaking turn of events, a 55-year-old man from Peñitas, Texas, has pled guilty to murder following the tragic shooting of his stepdaughter, Claudia Gallegos, on July 4, 2023. Leonardo Zapata Silva was sentenced to 35 years in prison on Wednesday, July 24, 2024. This incident has left the family shattered, raising pressing conversations about domestic violence and mental health.

Details of the Incident

The incident took place at the family home located at 1501 N. 11th St. in Peñitas. The probable cause affidavit reveals that Gallegos, 41, along with her daughter Crystal, attempted to leave the residence when Silva obstructed their exit. In a bid for help, Crystal reached out to her uncle, Joshua Silva.

Prior to the shooting, it is reported that Silva had made threats against Gallegos, stating he would take her life before his own. At approximately 9:22 p.m. that fateful evening, Joshua Silva heard a loud bang and observed his father aiming a handgun towards Claudia’s lower body.

The Aftermath

Upon police arrival, Leonardo Zapata Silva claimed he was just trying to "scare her in a joking manner," asserting he didn’t believe the gun was loaded. However, initial investigations indicate otherwise. The firearm was separated from its magazine, meaning Silva had to be aware of the bullets present.

As part of the sentencing process, Prosecutor Michelle Beltran read poignant victim impact statements from Gallegos’ sons, Mark and Christopher Silva. The family notably chose not to attend the sentencing, feeling the pain of their loss was overwhelming.

Mark Silva’s statement painted a picture of a loving mother, describing her as a "hard-working" woman who brought joy and laughter to their family. He expressed how his life feels "gray" without her presence and shared his fear that their family may never fully recover.

Christopher Silva shared his debilitating grief, stating he struggles to find peace even in his dreams, describing persistent nightmares. He mourned the fact that his newborn daughter will never have the chance to know her grandmother, deeming this loss as fundamentally unfair.
